The following applies to the Website and the information found on the Website. By visiting and using the Website the User expresses agreement with the terms of this User Agreement.
ALL information and images are subject to INTERNATIONAL COPYRIGHT LAWS in every country of the world. The copyright rests with the inventor and designer of the music notation system NOTUS, namely Erwin Clauws and his successors. The copyright of the publications (both digital and in print) rests at all times with the publisher NOTUS&BOOKS&SHEETS, founded by the aforementioned designer of NOTUS.
The User is therefore forbidden to download or transfer any information from the Website for non-private use (including for educational or informational purposes) without prior written agreement from the publisher NOTUS&BOOKS&SHEETS.
The User is forbidden to reproduce, further distribute or sell products purchased from the Website, by any means and under any circumstances (including for educational or informational purposes), without prior written permission from the publisher NOTUS&BOOKS&SHEETS.
The User is forbidden to, by any means, reproduce, further distribute or sell any information or products purchased from the Website in their own name, including for educational or informational purposes, without prior written permission from the publisher NOTUS&BOOKS&SHEETS.
Use of the NOTUS system of music notation
The User is forbidden to publish, freely distribute or sell the NOTUS system of music notation in any way or form without prior written permission from the designer of NOTUS or without receiving permission to do so as part of an agreement entered into by the User with the publisher NOTUS&BOOKS&SHEETS. The above provision applies to the publication of any NOTUS examples as part of educational or informational publications, any existing conventional scores that have been transcribed into NOTUS music notation and/or any compositions/examples that have newly been created. The latter applies whether the score has been directly notated in NOTUS notation or notated in conventional notation with a transcription to NOTUS to be further distributed either freely or commercially.
The User is however permitted to transcribe conventional examples and/or scores to Notus music notation for private use under the condition that they relinquish the copyrights to the transcribed Notus examples or scores to NOTUS&BOOKS&SHEETS. The User cannot therefore claim any rights for conventional music that has been transcribed by themselves to Notus music notation with the intension of selling or freely distributing it.
The publisher NOTUS&BOOKS&SHEETS and the designer Erwin Clauws accept no responsibility for the accuracy or necessary respect for the musical legacy of composers of examples/scores that have been transcribed to Notus for private use.
The publisher NOTUS&BOOKS&SHEETS and the designer Erwin Clauws are the only parties who may grant third parties the right and permission to transcribe conventional music notation to NOTUS music notation for further distribution outside of the private sphere either freely or commercially. The conditions under which this right is granted are subject to previously made agreements between the grantee of the rights and the NOTUS&BOOKS&SHEETS and its representation.
A User to whom this right is granted receives the status of an official NOTUS transcriber and carries full responsibility for the accuracy of the transcription and the necessary respect for the musical legacy of the composers whose work is being transcribed. This status grants the grantee the right and permission to associate their name with the transcription with the addition of the text 'Official NOTUS transcriber (grantee name) under contract no. (reference number assigned by NOTUS&BOOKS&SHEETS or Erwin Clauws)'. The permission to transcribe into Notus notation with the mention of the transcriber's name does not however imply possession of the copyright or commercial rights to the transcribed conventional score. This copyright and commercial right remains with the publisher NOTUS&BOOKS&SHEETS and the designer Erwin Clauws.
New compositions/examples created specifically in or for NOTUS music notation upon the request of the publisher NOTUS&BOOKS&SHEETS or Erwin Clauws are subject to a joint copyright between the author of the compositions/examples and the publisher NOTUS&BOOKS&SHEETS or Erwin Clauws. The conditions of this joint copyright are subject to previously made agreements between the author and the new compositions/examples and NOTUS&BOOKS&SHEETS and its representation.
New compositions/examples made directly (i.e. not as transcriptions from conventional notation) in NOTUS music notation or transcribed to NOTUS music notation from conventional notation, without prior written permission from the publisher NOTUS&BOOKS&SHEETS or the designer Erwin Clauws to use the NOTUS system of music notation, are in breach of the international copyright laws applicable to the NOTUS system of music notation and may thus result in prosecution, fines and the compulsory removal from the market and/or removal from the world wide web of the composition(s) in question.
